Sudanese Justice System Victimizing the Victims (Ms. H. A) case
STATEMENT
Ms H A was raped by four elements from the Rapid Support Forces in Khartoum in June 2023 she became pregnant as a result of that, she then moved to Wadi Halfa Northern State in her attempt to reach Egypt but due to the border closure she was stuck in Wadi Halfa, staying as Internally Displaced (IDP) in one of the schools in the area. When She gave birth to her child, she was asked for the child’s father or a marriage certificate, as she didn’t have that, the police arrested her and charged her under Article 146 of Sudan Penal Code 1991 (Adultery), Ms H A is a victim of a horrible crime and needs protection and support with her newborn child, We also learned from our network of lawyers and human rights monitors on the ground that other four cases are going through similar processes.
we urge the Sudanese authority to:
– Immediately release Ms H A and drop all the charges against her.
– Provide her and her child with the needed support and care.
– The Sudanese judiciary system and law enforcement agencies must stop the practices of
victimizing the victims.
